| 摘 要： | 在对英美法系物权变动模式进行类型化论述的基础上，比较分析契据移转与物权行为理论。提出英美法中的契据交付作为一种单方行为具有独立性和无因性，但由于英美法系特有的普通法与衡平法二元法律体系，使得英美法系的不动产物权变动表现出既有意思主义的一面又有形式主义的一面的特征。
