民主与法治是政治文明的重要组成部分，是和谐社会不可或缺的制度之维，分别从理论分析和历史经验两个纬度论证了民主与法治在构建和谐社会中的不可替代性。作为国家形态的民主，它不仅保证了和谐社会所要求的公平正义的实现，而且还有利于形成和谐社会所向往的安定有序状态。而法治的意义在于它不仅要求所有的权力运作必须设定在一定的轨道之内，而且还要求它必须符合全社会公认的最高道德与价值原则——良法原则，从而有效地保障和谐社会的实现。

Democracy and legality are most important parts of political civilization, and indispensable system dimensions of harmonious society. In the paper, the indispensability of democracy and legality in the eonstruction of harmonious society are discussed from two aspects such as theory analysis and historical experiences. Democracy as a eountry formation not only ensures the realization of justice required by the harmonious society, but also helps to form the peaceful state expected by the harmonious society. But legality not only requires that all power operation have to be limited in the certain track, but also to satisfy the highest morality and value principles admitted by the whole society---good law principles, thus effectively securing the realization of harmonious society.
