| 摘 要： | 我国流浪儿童的受义务教育权问题，无论是法律规定，还是社会实践都存在缺位。保障流浪儿童的受义务教育权是解决流浪儿童这一社会问题的关键。国家是保障流浪儿童受义务教育权的最终责任者。履行这一国家义务的最主要的形式就是立法、监督和资助。
