| 摘 要： | 不动产登记的性质是对不动产权属法律关系实施确认的行政确认行为,这一认识为物权登记中国家承担赔偿责任奠定了基础.登记机关承担国家赔偿责任时应采取过错责任原则.国家赔偿主要发生在登记机关过错造成登记错误而致损失的情形. |

| Abstract: | The nature of real estate registration is the actions of administrative confirmation which is to the legal relations of ownership of real estate. This understanding in the registration of property rights lays the foundation which the country undertakes the liability of compensation. When registration institution undertakes the liability of compensation,it should take the principle of the fault liability. The loss that results from the fault of registration institution is the main situation of state compensation. |
