| 摘 要： | 表见代理制度是为维护交易安全而设置的一项制度。在实践中 ,表见代理主要是在无权代理的情况下产生的 ,即善意无过失的相对人客观上有正当理由相信无权代理人有代理权而与之为法律行为。在表见代理的情况下 ,法律将使本人对于善意的相对人承担被代理人的责任。

| Abstract: | The purpose to institute the system of agency by estopple is to protect the safety of transaction.In practice,the agency by estoppel is mainly produced without the right of agency.That is to say,where an actor enters,without the right of agency,into a contract in the name of a principal,and where the counterpart acting in good faith has grounds to believe that the actor has the right of agency,the act of agency shall be deemed as effective. |
