| 摘 要： | 监理工程师的公正性一直是FIDIC的基石之一,但在最新版FIDIC合同条件下,工程师的公正性丧失了其重要地位。文章评述了导致这一变化的原因,指出这是FIDIC适应当前国际施工业发展的必然结果,认为这一变化对我国建设监理制度中监理工程师的定位及监理的本质属性的理解具有重要启示作用。

| Abstract: | The Engineer's impartiality has always played a fundamental role in FIDIC contract, but it losses its significance in the newest edition of FIDIC contract. This paper analyzes the reasons of this change by pointing out it is the inevitable consequence of FIDIC's adapting to the current development of the international construction industry, believing the change is of great enlightenment significance to understand the position of the engineer in China's construction supervision system. |
