略论WTO协议在我国的适用

我国已经加入WTO这一“经济联合国”,这一历史举措将给我国的政治、经济、文化诸方面带来前所未有的变化。在法律方面,中国加入WTO后面临的一个重要法律问题就是WTO协议在我国国内的适用问题。对于这一热点问题,学界有“直接适用说”、“转化适用说”和“维持现状说”等观点,诸说纷纭,莫衷一是。笔者认为:目前,在我国宪法尚没有相应规定时直接适用WTO协议缺乏法律依据,法院在审理案件中也不能直接适用WTO的协议规定。

The Application of WTO Agreements in Our China

With China's accession into WTO, China will inevitably experience unprecedented changes in politics, economy, culture etc. In legal aspect, an imminent issue lies before us: the application of WTO agreements in China. As to this hot topic, some points of view like "direct application doctrine", "transformed application doctrine" and "leave-alone doctrine" arise in the academic circle, but none of them can become dominant theory. In our views, since there are no relevant stipulations in the Constitution, direct application of WTO agreements is not convincing, which will leave the Chinese courts unable to directly implement WTO agreements at trial.
