我国政府雇员制立法探微(下)

摘    要:中国语境下的"政府雇员",是指在公务员体制以外,通过聘用合同受雇于国家机关,从事辅助性、临时性事务,由国家财政负担工资、社会保险的工作人员。理论上,"非公务员身份"非权力性"辅助性"临时性"弹性化"和"低薪制"是其制度的基本特征。为推进我国人事制度法制化进程,须借鉴域外行政主导和立法的经验,立足本国国情,就监督管理、权利义务、聘任合同、法律责任、法律冲突等问题进行初步探讨。
