论城市化进程中的农民私权自治

农民私权无保障的弱势地位导致其在城市化进程中的边缘化.运用组织行为学的参与管理理论、当代行政法学"行政权--公民权"的平衡理论和西方发达国家在发展中国家实施扶持项目的过程中形成的村民参与管理理论并结合我国村民自治制度进行综合分析发现,在推进城市化进程中应当实现农民私权自治,其核心是被征地农民的参与管理权,主要包括知情权、询问权、评议权、表决权、监督权、诉讼权等.

The Autonomy of Civil Right of Peasants in Urbanization

Peasants' social position as weak group with private rights unguaranteed leads to the marginalization in the process of urbanization.This article is based upon the participation management theory of organizational behavioral science and the equity theory of administrative law,the author thinks it is pre-requisite thing that the peasants hold the participation management right during the course of urbanization.In practice,the right can be hold by the committee of peasants whose land has been requisitioned.Then the participation management right of the peasants should become reality.
