以范式转换为立基的环境刑事立法新探与制度重塑

人与自然的和谐共处是和谐社会系统的应有之义，生态环境被破坏的日益严重化以及对人类的重要性决定了我国应更加强化对生态环境的保护。由于传统环境民事、行政责任规制的疲软与对外部不经济性的内化不足，环境刑法的出现便具有了其历史的必然与必要。扭转以往的人类中心主义道德伦理范式进而转向更为科学合理的生态中心主义是环境刑事立法的应然选择。立基于社会利益格局的改变、道德共同体内涵的拓展与社会风险管理的需要，以生态中心主义为纲重塑我国环境刑法是我国环境保护法律体系走向理性化的科学路径。

The harmonious relationship between human and nature is one of proper meanings of harmonious society,ecosystem environment is broken increasingly serious and important to human determine that human should pay more attention to the protection of environment.Because of traditional environmental civil liability and administrative liability's weaking and dealing with external diseconomy failure,the foundation of environmental criminal law have its inevitaility and necessity.Turning the moral and ethics paradigm of anthropocentric to ecocentrism more reasonable is the legislation of environmental criminal law'ought to be choosing.On the basis of the change of social benefit pattern,expanding of moral community content and necessity of management of risk society,taking ecocentrism as outline to rebuild environmental criminal law is often considered a scientific approach where the environmental protection law system of China get to be reasonable.
