刑事回避制度的缺陷剖析及重构

刑事诉讼中回避制度的设置有其重要的核心价值、理性价值和延伸价值，对于领导干部而言，由于其特殊的权力、影响力，适用回避制度的意义更加重要。但是回避在现行的刑事诉讼规定中存在一定的缺陷，尤其是对公安司法机关负责人的回避在法条规定和程序设置上有诸多瑕疵。通过对发现的这些缺陷进行深入的考量和分析，重点找寻出问题的症结，从五个方面提出完善的方案，希望使回避制度的架构更加严谨，为权力的廉洁规范化行使提供参考。

An Analysis of the Defects of Criminal Challenge System and Its Reconstruction

The setting of challenge system in criminal proceedings has its core value, rational value and extension value, the application of which is of greater significance for leading cadres because of their special power influence. But the defects of the challenge system are found in the current criminal procedure rules, especially in the law stipulations and program settings on the challenge of persons in charge of public security and judicial organs. With a thorough analysis of these defects, this article focu- ses on the crux of the problem, and then puts forward proposals in five aspects. It is hoped that these suggestions help with a more rigorous challenge system and provide some reference to the honest and standardized exercise of power.
