第三法域之“三农问题”论纲

“三农问题”首先是一个政治问题,从法治社会角度而言“三农问题”同时也是一个法律问题,而且是一个社会法问题。社会法是国家为解决各种社会问题而制定的具公、私法相融合特点的第三法域。私法仅就农民利益问题寻求救济,而国家行为对市民社会亦难以作为,故“三农问题”由于牵涉到社会整体利益,应归于第三法域———社会法调整范畴,文章以社会法视角,从降低农业人口、农村城市化和农民教育三方面,审视我国当前“三农问题”。

Three Rural Issues , a Third Field of Law Perspective

Issues of agriculture,farmer and rural are political issues,and legal issues also from the point of legal view,further more it is issues of the social law.The social law is the third field of law which is instituted by government for solving the social problems.Neither the private law nor the public law can solve the problems combined with agriculture,farmer and rural,so only the social law to resolve them from reducing the population of farmers,modernizing the rural areas,educating farmers and etc.
