| 摘 要： | 最高人民法院于2000年相继颁布了<担保法>和<票据法>的相关解释,但却导致了对票据质押背书的性质的争论,即究竟是票据质权的对抗要件还是取得要件?我们可以从理解票据质权人行使票据权利的性质入手,突破理论陈规,以票据质押构成要件的二元构造论解析了质押背书的性质.
