授予权力与授予权利：法律规范的基本功能

权力与权利需要法律规范来授予。法律规范虽然也要规定义务与责任,但法律规范的基本功能并不在此,法律规范的基本功能在于授予权力与权利。无论是授予权力还是授予权利,都存在着多种方式。法律规范之外的权利具有正当性,但难以得到法律规范的保障;法律规范之外的权力一般不具有正当性,有待于法律规范加以规制。

Granted Right and Granted Power:on the Basic Functions of Law Norm

Power and right need to be granted by the law norm. The main value of law norm is not to grant the duty and liability but the power and right. The granted power and right take many a form. The right beyond the law norm cannot be protected by law though it is justifiable, while the power beyond the law norm in general is not justifiable and therefore need be ruled by the law norm.
