| 摘 要： | 我国夫妻离婚后扶养制度在立法与司法上均存在不足,完善这一制度对实现社会公平、促进社会和谐具有非常重要的意义。参照各国扶养制度,我国立法应在扶养的性质、扶养请求权的主体和行使时间、扶养的构成要件、扶养的种类和期间、扶养费的给付标准与方式、扶养请求权的限制、扶养费给付的终止等方面作出规定。

| Abstract: | This paper starts with examining the legislative and judicial status quo of the maintenance system after divorce in China, analyzing the value and function of the maintenance system, and comparing the legislative cases on divorce in other countries. Then the paper makes some suggestions about the improvement of the maintenance system after divorce in China so that the maintenance system can be more rational and more consistent with the spirit of law for protecting the rights of the divorce parties concerning equality, human dignity and the freedom of the divorce. |
