中国近代专利制度的萌芽及形成过程艰难而曲折.在近代中国社会转型的背景下,它经过了晚清时隐时现的萌芽时期以及被迫承认的内外保护时期;民国初年,专利保护开始设章定制,而内容仍多变不定.国民政府时期,专利制度从形式上和内容上逐步完善.1944年,我国历史上第一部比较完整的包括发明、新型、新式样的专利法正式公布.

The Changes of Patent System in the Transformation Pperiod of Chinese Society in Modern History

The appearance and formation of Chinese patent system in the modern history was difficult and tortuous.Under the background of the social transformation in China,it went through the budding period flickering in the late Qing dynasty and the internal and external protection period which was forced to be acknowledged.At the beginning of the Republic of China rules and regulations were to be stipulated which yet remained quite flexible.Under the reign of the Nationalist Government the patent system got much improved in both form and content.In 1944 the first integrated Patent Act was officially publicized which included invention,new model and new style.
