| 摘 要： | 构建科技反哺农业有效机制是反哺农业的智力保障,相对完备的科技反哺农业立法是推进科技有效反哺农业的必要前提,农业技术推广法的修改是完善我国科技反哺农业立法的开始。可应用形式逻辑的方法,从法律行为、法律关系两方面厘清科技反哺农业立法的共识性基本要素。以新农业技术推广法为核心的我国科技反哺农业立法虽已基本完备,但在预期法律效果和法的系统化上仍存在不少问题而影响了立法的运行实效。应基于对科技反哺农业法律行为、法律关系的厘清,明晰新农业技术推广法的预期法律效果、实现其他相关法律的科技反哺农业规定系统化。

| Abstract: | Constructing an effective mechanism is the intellectual support for science and technology back-feeding agriculture as a relatively complete legislation for it is a perequisite, and the modification of the law of agro-technique extension is only an initiation. The method of formal logic can be applied to discovering the collaborative basic elements for the legislation in the perspective of legal act and legal relationship. The legislation of science and technology back-feeding agriculture with the new edition of agro-tech- nique extension law as its core has been basically completed, but in prospective legal effect and systematization of law, there re- main problems affecting its operation. The clarification of the new edition＇ s prospective legal effect and the realization of the sys- tematization of provisions are based on the clarification of legal act and legal relationship for science and technology back-feeding agriculture. |
