民间法研究的使命

20世纪90年代以来,中国法学界掀起了一股民间法研究热潮。但民间法研究的使命何在一直暗昧不明,这不能不制约民间法研究的深入和民间法的复兴。当代民间法研究应当肩负探寻民间法的话语系统,推动民间法的合法化,引导民间法与国家法之间的互动,以及重建社会信任系统四大使命,其中,尤应对民间权威给予充分关注,通过对其积极引导和有效规制,使其更好地服务于研究使命的践履和法治社会的建设。

On the Mission of Folk Law Research

Since 1990s,Chinese jurisprudential circle has set off an upsurge of folk law research.Unfortunately,it has been ignorant of the mission of folk law research.Inevitably,this condition restricts the further development of folk law research and the revival of folk law.In fact,the contemporary folk law research shoulders the responsibilities of exploring the discourse system of folk law,promoting the legalization of folk law,conducting its interaction with national law and rebuilding the social trust system.Especially,the folk authority should be paid sufficient attention to during the whole research.Only under positive guidance and effective regulation can folk authority be a better server for the fulfillment of research mission as well as the construction of the society governed by law.
