| 摘 要： | 无论是英美法系国家还是大陆法系国家,多对亲属免证权作出了相关规定,我国香港、澳门以及台湾地区亦是如此。我国刑诉法从1979年立法至今经过了1996年和2012年两次较大修订,均未对亲属免证制度进行明确规定,2012年修改后的刑诉法在明确证人强制出庭制度的同时,赋予了被追诉人的配偶、父母、子女不被强制出庭的权利,在一定程度上带有免证特权的色彩,却并非真正意义上的亲属免证特权。通过对亲属免证权的考察,指出亲属免证权的必要性,在比较借鉴域外以及我国香港、澳门、台湾地区关于亲属免证的相关规定基础上,对我国亲属免证制度的构建提出见解。

| Abstract: | The immunity of relatives witness is guaranteed in the countries of both common law system and civil law system,and so is in the regions of Hong Kong,Macao and Taiwan in China.The 1979 Criminal Procedure Law of the People’s Republic of China has been amended materially twice,respectively in 1 9 9 6 and in 2012,and the 2012 revision allows relatives to refuse testifying,going close to the immunity of rela-tives witness.This article discusses the right of immunity of relatives witness,emphasizes the necessity of the right of immunity of relatives witness,draws some reference from the relevant provisions in neighbor-ing regions and countries,and gives some suggestions on the establishment of the rej ecting-relatives-testi-fy-right system. |
