论民间表演艺术集体表演者追索权立法保护

On Legislation to Protect Folk Performing Arts Group Performancers' Right of Pursuit

Folk performing arts group performancers''right of pursuit is an important aspect of performer''s rights and a kind of new independent right. It is similar but distinct from neighboring rights because of its uniqueness. The protection of right has been stipulated in foreign countries and international conventions, except China. To protect the right in China is of great significance for development of folk arts industry and culture. Chinese legislation to protect the right should include subjects of rights, the exercise methods, the term of protection, security and implementation and other aspects.
