| Abstract: | Silence right and defence right constitute two cardinal rights to protect the accused in modern criminal lawsuits. In the course of criminal proceeding model transition, the proceeding position of the defendants is rather low and the defending function remains very weak in China's judicial practice. Therefore, the implementation of silence right is of realistic significance. |
