| 摘 要： | 马克思主义唯物辩证法的对立统一规律为 刑事辩护制度化打下了坚实的基础，使刑事辩护制度步入理性化时代。刑事诉讼中最根本、 最显著的矛盾便是控诉与辩护的矛盾，控诉与辩护二者既对立又统一，共同维护了司法的准 确、严明。刑事辩护制度将在对立统一规律的指导下进一步走向成熟和完善。

| Abstract: | The law of the unity of opposite based on the materia list dialectics of Marxism lays a solid foundation for the criminal vindication system and also brings the system to a rational time. The most essential and rem arkable consideration of criminal litigation is between complain and vindication . The relations of the said problems between them is opposite and united so they can together serve for the juridical nicety and solemnity. The criminal vindica tion system will gradually become matured and perfected under the direction of t he law of the unity of opposite. |
