摘    要:建筑物区分所有权是由区分所有人对建筑物专有部分享有的专有权和对共有部分享有的共有权所构成的一种特殊物权。管理权已融入所有权之中,不存在独立的、为管理而生的、非财产性的成员权.相邻权不是所有权的一种权利形式。建筑物区分所有权不是按份共有和共同共有。在建筑小区内.任何建筑物或设备设施.不是业主个人所有的,就是业主共同所有的.不应存在第三方对权利的享有.故车位车库、天台、会所等.均应由全体业主共有。
