浅议“其他组织”的法律地位 ———对我国民法典主体制度的思考

"其他组织"在当前社会经济生活中发挥着日益重要的作用,但是其法律地位在我国法律制度中尚不明确,不具有民事主体资格.从我国立法、理论现状和实践困境人手,在比较国外法律制度、理论的基础上,结合我国现实来看,应当赋予"其他组织"以民事主体地位,而在未来的民法典中应构建一个开放性的民事主体制度.

The legal status of the "miscellaneous organization"--reflect on the system of main body in China's civil code

The "Miscellaneous Organization" is playing an increasingly important role in the economic life nowadays,but its legal status has not been clear in our law system nor has been recognized as a civil body yet.By analyzing the present legislation,theory and practice of the legal status of the "Miscellaneous Organization" in our country and on the basis of comparing them with foreign conditions,the author suggests that the law-maker should grant the status of a civil body to the "Miscellaneous Organization" and establish an open system of the civil main body in our future civil code.
