| 摘 要： | 日益增多的高校学生诉学校管理行为的案件,使司法审查介入高校学生管理领域成为必然。司法审查介入高校学生管理纠纷的范围应从介入其深度和广度这两个维度来考察。司法审查在介入高校学生管理纠纷中,不是无所顾忌,而应遵循一定的原则,如有限介入原则、保障学生基本权利原则,尤其是学术节制原则应得到适用。

| Abstract: | The increasing cases of college students accusing the college make it necessary for judicial reviewtointervene student management in higher institutes.The scope of the examination should be considered fromthe per-spective of depth and extent.In this process,judicial reviewshould comply with some principles such as restrictedintervention,ensuring the students' fundamental rights,especially the application of the principle of academic ab-stention. |
