| 摘 要： | 事实与价值二分法指导下的合法性研究将合法性理论分为经验主义合法性理论和规范主义合法性理论.前者强调合法性中的事实因素,后者强调合法性中的价值因素.而现实中的合法性同时具有事实与价值的双重属性,是事实与价值的统一,是基于认可的服从.

| Abstract: | The legitimacy study under the guidance of the dichotomy of facts and value classifies legitimacy study into empirical legitimacy theory and normativist legitimacy theory.The former stresses the factual elements of legitimacy while the latter stresses the value elements of legitimacy.And legitimacy in reality has a dual property of facts and value and is a combination of the two,an obedience based on recognition. |
