| 摘 要： | "以人为本"是对"国家尊重和保障人权"的诠释,是政府义不容辞的责任,其实质是以公民的基本权利为政府权力行使的根本。在突发事件应对法中确立"以人为本"的原则既有助于国家在突发事件中积极行使权力,也有助于防止国家滥用权力。总体而言,"以人为本"原则在我国的突发事件应对法中已经有了较好的体现。但未来仍需要完善现行突发事件应对法律制度,以使"以人为本"原则得到更充分的体现。

| Abstract: | 'People-orientation' is the interpretation of the principle that the state respects and protects human rights and it is the duty-bound obligation of the government.The essence of 'people-orientation' is that the exercise of state power should concentrate on the protection of citizen's fundamental rights.It is beneficial to take 'people-orientation' as the principle of the legal system in handling emergency to exercise the state power on the one hand,and protect the state from abusing power on the other.The ... |
