论我国法官权威的缺失与对策

司法权威是法治社会外在标志之一,法官权威是司法权威的核心内容。目前,我国法官权威存在着缺失,这直接影响司法公正和司法权威的实现。本文从法官权威应然基本理论出发,客观分析法官内在权威与外在权威缺失的现象,探寻我国的法官制度中存在的深层问题,并提出改革之对策。

On the Absence of Judges' Authority in China and the Countermeasures

Judicial authority is one of the external signs of a law-based society,of which judges' authority is the core.At present in China,the absence of judges' authority has a direct effect on the accomplishment of judicial fairness and judicial authority.According to the theory of the obligation of judges' authority,the thesis makes an objective analysis of the absence of judges' internal and external authority,probes into the in-depth issues in China's judge system and puts forward the countermeasures to reform the system.
