论非法人社团的民法制度构造

非法人社团作为参与社会活动的重要主体,在弥补政府与法人社团的失灵、促进社会福利供给以及推动社会治理创新等方面具有十分重要的意义。然而,囿于我国现行立法的规定,其在实践中面临着合法性和参与民事活动的困境。借鉴国外的立法,我国应该从社会实际出发,赋予非法人社团民事权利能力,承认其既不同于法人,也不同于合伙的独立的民事主体地位,并在此基础上予以相关的制度构造。

A Discussion on the Construction of the Civil Law System of Unincorporated Association

As important participants in social activities,unincorporated organizations have an important position in compensating for the government and corporate failures,facilitating the provision of social welfare,and promoting the Innovation on social governance.However,due to restrictions of current legislation,there are many troubles for unincorporated organizations to participate in civil activities.Learning from the other countries,the law in our country should give the unincorporated organizations capacity for civil rights,and recognize their own dominant position.
