| 摘 要： | 传统知识是传统部族在历史漫长的精神生产和知识创新过程中孕育、传承而成的结晶。文章通过从传统知识与公共领域、传统知识"传统性"与知识产权对象"创造性"、传统知识"群体性"与知识产权"个体私权"三个方面对知识产权制度下的传统知识保护进行困境解读,期冀为传统知识的保护模式选择提供必要的理论基础。

| Abstract: | Traditional Knowledge(TK) is invented,developed and transmitted by indigenous peoples in a long history.By interpreting the plights between TK and public domain,plights between traditionality of TK and creativity of intellectual property,and plights between character of fellowship of TK and civil rights of intellectual property,the paper provides a theoretical basis necessary for the developmental pattern of TK protection. |
