| 摘 要： | 答辩失权制度作为民事诉讼审前程序的组成部分,起着明确争点、加快诉讼进程、提高庭审效率的作用。反思我国缺失此制度在实践上造成的诸多弊端及实施此制度面临的障碍,提出了构建我国答辩失权制度的基本设想。

| Abstract: | As one of the components of pretrial civil litigation,system of defense invalidity has the effects of clarifying counts,accelerating the legal action,improving the efficiency of trial.The drawbacks in practices and obstacles in carrying out the system of defense invalidity are reflected, and the basic assumption of constructing the system of defense invalidity is put forward. |
