生态文明建设与环境法的价值追求

环境法产生和兴起于环境危机的时代，在法律领域承载着应对环境危机的历史使命。建设生态文明的目标与完成环境法的历史使命高度契合，环境法是保障生态文明建设首位重要的法律部门。为了保障和促进生态文明建设，环境法的价值追求应该以生态文明为应然目标、以人与自然和谐共处为基本理念。由此，环境法呈现出完全不同于传统法律部门的价值追求：环境法的正义价值表现为追求多面的正义，包括代内环境正义和代际环境正义；环境法的秩序追求是生态秩序；环境法的利益追求是在优先保护生态环境利益的前提下，寻求生态环境利益、经济利益和精神利益的协调与最大化。
