建立以案件审理为中心的案例指导制度

The Establishment and Exploration of Cases Guidance System (topic for special discussion)

Cases guidance is successful summary of court judgment experience and an important means of the high court guiding low court.From 1949 to the 1990s cases guidance went through turns and twists filled with experience and lesson.Since 2000 cases guidance has developed fast and come into system.Now the Internet has made the ways of cases change greatly with which modes of cases guidance should be adjusted,so establishing cases guidance system has both theoretical and practical significance.The researchers at this conference of cases guidance are judges with practical experience and young theorists of law who gave further exploration from different angles.The cases come from lawsuits of public welfare,cases of civil rights involving foreign countries,status and effectiveness of cases from civil law.Perhaps these opinions in the essays need to be amended and perfected,but theoretical exploration is also an important component of establishing cases guidance system.
