| 摘 要： | “犯罪化”、“处罚的早期化”、“严罚化”和“国际化”,是当今世界范围内的刑事立法动向。“和谐社会”作为我国刑事立法的价值追求,应在世界刑事发展的大背景下,进一步完善刑事立法,在刑法典中增设新的罪名,扩大某些犯罪的构成要件,提高某些犯罪的法定刑。

| Abstract: | Criminalization,early and severe punishment,and internationalization are all trends in the criminal legislation around the world.In China,under such a global background,as the purpose of criminal legislation is to help build a harmonious society,we should make our criminal legislation perfect by adding new crimes to the China Criminal Law,by extending constitutive requirements of some kinds of crimes,and by enhancing some crimes' legal sentence. |
