论民主与法治社会中的德治

我们谈论德治 ,应当注意它的主体、对象、内容、方式以及限度等方面的意涵。在民主社会 ,“德治”首先意味着对于行使公共权力的政府官员的道德教育 ,其次意味着政府经公民授权对社会的道德教育。“德治”应当依法进行 ,不能突破法治的原则和规范 ,并应当注意自身的制度建设。

On Democracy and the Rule by Morality in a Law-governed Society

While talking about"rule by morality", we must pay attention to such implications as its subject, object, content, means and limits. In a democracy,"rule by morality" means, first of all, the moral education of government officials who exercise their functions. And, then, it means the moral education of the whole society, which is conducted by the government and authorized by the people."Rule by morality" should abide by the laws and should not break the principles and norms of "rule of law." In addition, importance should be attached to institutional improvement.
