自由在契约论伦理思想中的统一——从卢梭到罗尔斯

从霍布斯、卢梭到罗尔斯、诺齐克，契约论伦理思想可谓在近代以来的历史之中显现了强大的内在张力。而无论古典主义契约论伦理思想亦或罗尔斯的契约论伦理思想，其理论建构的前提均含有自由，并使其在思想中达到一种统一。就内容而言，卢梭和罗尔斯均是从一种个体自由上升到社会自由（社会正义）；就思维而言，他们均是从自由意志上升到公共意志。文中通过对卢梭和罗尔斯的分析阐述自由在契约论伦理中的统一，旨在表明自由精神的价值和生命。

Consensus of Freedom in Ethics of Contract Theory——From Rousseau to Rauls

From Hobbos and Rousseau to Rauls and Nozick, ethics in contract theory has demonstrated its powerful inner tension in modern history. The precondition of its theoretical construction, either in ethics of contract theory of classicism or in that of Rauls, enrbodies freedom, which led to consensus theoretically. In terms of content,both Rousseau and Rauls upgraded from a form of individual freedom to social freedom （ social justice） ; in terms of thinking, they both upgraded from free will to public will. This paper, by way of analyzing Rousseau and Rauls, elaborates the consensus of freedom in ethics of contract theory, aiming to reveal the value and vitality of free spirit.
