| 摘 要： | 以法院内部权力结构为视角 ,用结构——功能主义的方法详细剖析现阶段我国法院行政审判合议庭的组成、权限、内部元素及影响其运作的外部因素 ,可以得出结论 ,立法所赋予行政审判合议庭的裁判权已被逐步侵吞、蚕食 ,司法实践中行政审判合议庭享有的独立审判权是非常有限的

| Abstract: | By taking the internal power structure of the court as visual angle and by way of structure functionism method to thoroughly analyze the construction, limits of authority, internal elements and the external elements that affect the action of the court administrative trial collegiate that our country carries out nowadays, it can be concluded that the judge right of the administrative trial collegiate given by legislation has been swallowed step by step and its independent trial right is very limited. |
