| 摘 要： | 出租作为土地承包经营权的流转方式之一,既可以将土地的所有权与使用权进一步分离,使产权明晰化,又可以促使土地与其他生产要素优化组合,提高生产率。但是就中国目前的立法而言,存在诸多问题。从分析土地承包经营权出租的主要法律特征入手,在理清土地承包经营权出租的主体资格的基础上,对实践和立法中存在的问题予以分析并加以完善。
