| 摘 要： | 死刑是剥夺人生命的极刑,适用死刑必须十分慎重。目前世界上虽然有一百多个国家不再执行死刑,但人口在两亿以上的国家都保留了死刑。在我国关于死刑存废的争论十分激烈,大多数学者认为我国尚不具备废除死刑的现实条件,但要严格限制死刑的适用。限制死刑的措施包括由最高人民法院统一行使死刑复核权,尽可能减少死刑罪名,扩大限制适用死刑的主体,并完善相应的替代刑罚体系。

| Abstract: | Death penalty should be carried out very cautiously since it is a terminal punishment depriving of a person's life.Most of scholars suggest strict limits be set on the execution of death penalty.Those measures include the double check should be only practised by the Supreme Court,reducing accusations that lead to death penalty,enlarging principal parts which have the power to limit the practice of death penalty,and perfect the relevant systems substituting death penalty. |
