我国碳排放权交易基本问题探讨

碳排放权交易将市场机制引入到碳减排工作中,以较低的成本达到减排目标,促进资源的优化配置.我国于今年开展了碳排放权交易试点工作,发布了一系列政策并更新了技术条件,但是却存在较为严重的法律规范缺位现象.因此,我国亟须通过立法来确认和规范碳排放权及相关许可证、交易主体、交易规则等基本问题,明示其合法性与正当性以保护碳排放权交易市场的长期、稳定、健康运行.

On the Basic Issues of Carbon Emission Permit Trading in China

Carbon emission permit trading introduces market mechanism into carbon emission re- duction in an attempt to meet the target of emission reduction at a lower cost and promote the optimal allocation of resources. This year China has carried out the pilot projects of carbon emission permit trading,issued a series of policies and updated the technical conditions, but the relatively serious vacancy phenomenon of legal norm does exist. Therefore, in order to guarantee the long- lasting, stable and healthy operation of carbon emission permit trading market, we are desperate for laws and regulations to confirm and make normative such basic issues as carbon emission right, relevant permits, transaction participants and trading rules, and to give explicit expression to its legitimacy and validity.
