中国—东盟自由贸易区的法律合作正从贸易自由化向可持续发展演进,可持续发展合作已成为中国—东盟自由贸易区建设的战略目标和法律实践。这是中国与东盟从共同利益出发,合理解决各国的发展差距和区域的环境资源问题,建立面向和平与繁荣的战略伙伴关系的法律博弈结果。为实现可持续发展的法律演进,中国与东盟应当保持和加强建设双方贸易、投资领域的合作机制,积极推进区域协调发展合作的机制化、法制化,实施中国与东盟环保合作战略。

From Free Trade to the Regional Sustainable Development:Legal Evolution and its Corresponding Countermeasures for CAFTA

The legal cooperation evolution in China-ASEAN Free Trade Area is going ahead from trade liberalization to sustainable development.The sustainable development cooperation has become the strategic target and legal practice for the construction of CAFTA.This is the result of legal game between China and ASEAN,based on the common interests,for the goal of reasonable solving all countries’ development problems and regional gap in the area of environment and resources,and constructing a peaceful and prosperous strategic partnership.To realize the sustainable development in the evolution of legal system,China and ASEAN should maintain and strengthen the construction of cooperation mechanism in bilateral trade and investment fields,promote the institutionalization and legalization of the coordinated development and cooperation in regions,and implement the strategy of environmental cooperation between China and ASEAN.
