| 摘 要： | 在网络传输和计算机运行过程中,临时复制大量产生,对网络著作权人的复制权产生了深刻的影响.因此在完善<信息网络传播权保护条例>时,应在厘定临时复制问题法律性质基础之上,先规定技术性临时复制和非技术临时复制的法律对策,后以定义的形式明确技术性临时复制和非技术性临时复制的法律区分标准.此种立法进路,有利于实现著作权人和公众在网络环境下利益机制的平衡.

| Abstract: | Temporary duplication appearing considerably in the process of internet transmission and computer operation exerts a profound influence on the duplication right of copyright owners. As a result, when improving "the Protection Ordinance of Information Networks Dissemination Rights", the legislative body should first dictate legal measures for technical temporary duplication and non-technical temporary duplication, secondly definitude legal distinction standards between technical temporary duplication and non-technical temporary duplication in the form of definition, on the basis of analyzing lawful nature of temporary duplication. This legislative approach helps achieve the balance of interest mechanism between copyright owners and the public in cyberspace. |
