宋代蕃法及其向汉法的过渡论略

北宋前期,以“蕃法”处理周边民族地区的矛盾和纠纷,同时间用“汉法”,形成“蕃汉各为一法”的法律基本格局,但在真宗天圣时期,由于蕃汉民族间交往的日益增加,宋廷“汉法”治蕃部的法律意向已随之产生并日益明朗化,此后“蕃法”逐渐开始向“汉法”过渡。北宋后期,由于政府积极边疆战略的实施和对边区部族治理的深入,这种过渡或转变有了更进一步的发展,并首先在西北和西南部分地区成功实现了转变,客观地反映了宋代民族法律文化的历史性发展和进步。

The Fan Legal and its Reform to Han Legal in the Song Dynasty

The Fan Legal was a basic principle of the regulations which regarded as dealing with complicated relationship of the minority areas in the Song Dynasty.Because of the increase connection between Fan People and Han People,however,there was a new of ideals which regulation of the Fan Tribe minority by Han Legal during the period of the Zhenzong emperor,and the evolution from Fan Legal to Han Legal appeared greatly here.The reform had made progressed because of the execution of policies which the activer measures expanding the Northwest regions in the later period of the Northern Song Dynasty,and it accomplished in some areas in the Northwest and the Southwest.These law,a matter of fact,showed a progression of the legal cultures in the ethnic regions in the Song Dynasty.The article tries to research this problem.
