| 摘 要： | 在保证人破产时,如何兼顾各方当事人的利益,妥善处理破产企业的财产,现行立法及司法解释的规定还存在着一定的缺陷。本文拟对保证人破产中涉及的有关问题结合立法与实践进行讨论,并对完善我国的破产立法提出几点看法。

| Abstract: | The present legislation and the judicial interpretation stipulation still have some certain flaws about how to give dual consideration to all litigants' benefits and properly deal with the property of the bankrupt enterprises when a guarantor is bankrupted.This article discusses some problems related to the guarantor bankruptcy in terms of legislation and practice,and puts forward some ideas about the perfection of bankruptcy law. |
