| 摘 要： | 混合经济中的政府与市场作为两种截然不同的制度安排,是共生共存的。政府所具有的普遍同质性和合法强制性的特征,导致了政府规制市场的特殊性。在两者关系上它主要表现为政府规制市场进程中的不同条件(包括基础性条件)、必要性条件和限制性条件。基于这一规制行为的条件特殊性认识,在合理界定政府与市场各自的有效行为边界的前提下,探寻政府有效规制市场的路径选择。

| Abstract: | As two institutional arrangements utterly different from each other, government and market coexist in a mixed economy.However,the universal homogeneity and legal power of compulsion of government cause the government regulation of market to possess special characteristics,which are mainly reflected in different conditions in regulating market, including the basic condition, the essential condition and the restrictive condition.Recognizing the special conditions of regulation and predicated on the fact that government and market have their respective limited range,this article concludes with the methods of effective government regulation of market. |
