| 摘 要： | 环境犯罪是二十世纪中后期出现的一种新型犯罪 ,采用何种立法形式和原则对环境犯罪及其刑事责任作出规定 ,一直是各国学者探讨的话题。我国关于环境犯罪的立法也经历了由不完善到相对完善的过程 ,现行刑法虽然在强化环境保护方面功不可没 ,但在立法中仍存在着种种不足和尚待完善之处

| Abstract: | As a new type of crime, environmental crime appeared in the middle of the 20th century. The legal treatment of this kind of crime has long been the concern of scholars of many countries. China's legislation of environmental crime has undergone a process of gradual perfection. The present criminal law plays an important role in environmental protection but it still has much room for improvement. |
