船舶油污损害的赔偿范围

1969年责任公约与1971年基金公约构筑了船舶油污损害的民事赔偿法律制度。其中赔偿范围在实践中仍存在较大争议,在纯经济损失、环境损失等方面尤为突出,很大程度上影响了赔偿的顺利进行。明确界定赔偿范围显得尤为必要。我国在船舶油污损害赔偿范围的界定上仍然存在模糊与矛盾之处,必须结合先进国际立法与国情做出相应改革,以更好推动航运业的发展。

On the Compensation Scope of the Oil Pollution Damage from Coast Ships

1969CLC and 1971FUND have established the legal system of civil compensation for oil pollution damage. However, some disputes exist in the scope of compensation, especially in the pure economic loss and environment loss, which have influenced the smooth running of compensation. It is essential to clarify the scope of compensation. In China, the definition of the compensation scope is not clear and contradictory. To promote the development of shipping industry, corresponding reforms must be made out combining with the advanced international legislation and national conditions.
