| 摘 要： | 海域具有区别于一般物的特定性及特有的流动性、共享性,在民法上应属于特殊不动产。海域使用权既不属于自然资源使用权,也不是资源物权,宜将其放在物权法用益物权制度中规范调整。海域使用权具有特殊的效力,涉及到相邻关系、地役权等问题,需要各方面的综合协调。

| Abstract: | Compared with ordinary things, the maritime space shows some special characters, that is, the maritime space is flowing, can not be defined exactly and can be shared with others. Thus, it belongs to the special realty in the civil law. Because it is neither natural resource right of use, nor resource real right, it should be regulated by the system usufruetuary right in the real law. Maritime right of use has special effect and involves adjacent relation-ship and easement, so when dealing with it, we must coordinate with other law systems. |
