归责体系：一元与二元之间——浅论环境污染的侵权责任

在环境污染侵权领域,仅以有损害后果以及污染行为之间的因果关系,不论其行为是否合法,笼统适用无过错责任原则的一元规则体系往往不利于当事人真正实现权利.现阶段应引入二元归责体系,以公平责任弥补无过错责任原则在保护上的单方性和惩罚上的绝对性之不足,使两者能够在该体系中实现互补与协调统一,真正构建出相对合理的归责体系.

On the Liability for Tort of Pollution of the Environment

This article serves as a preliminary research of the problems caused by the unification of the system of liability for tort of pollution of the environment. It argues that we should introduce fair liability into the old system in the aim of remedying the defect of non-fault liability. With the help of dualistic liability system,we can build a more harmonious system which can protect the rights of our people in a more reasonable way.
