| 摘 要： | 采取公法与私法二元划分法,将高校与学生之间的法律关系分为公法关系与私法关系,旨在明确高校权力与学生权利的界限,规范高校权力的行使,保护学生权利。在学生的教育权受到侵犯时,可寻求合理有效的救济。

| Abstract: | The dual division of public law and private law prescribes the law relationship between university and students as the relationship between public law and private law. It is intended to nail down the boundaries of the university power and the students ’ rights, normalize the execution of the university power and protect the students’ right. |
